Important: ATM is an education + software platform. Nothing here is financial, investment, legal, or tax advice. Trading involves risk, including the risk of loss. You are responsible for your decisions and compliance with applicable laws. These Terms form a binding agreement between you and [Company Legal Name] ("ATM," "we," "us," or "our").
1.1 Age/authority. You must be at least 18 years old and have the legal authority to enter this agreement.
1.2 Account security. You are responsible for safeguarding your credentials and all activity under your account. Notify us immediately of any unauthorized use.
1.3 One person, one account. Accounts and subscriptions are non-transferable.
2.1 Education + software. ATM provides training materials, community access, and a private TradingView research script (and related tools) for educational use.
2.2 No advice. We do not provide individualized trading advice, portfolio management, or fiduciary services.
2.3 No auto-trading on your behalf. We do not place trades for you or control your brokerage/exchange accounts.
3.1 License. Subject to your compliance, we grant you a revocable, non-exclusive, non-transferable, limited license to use the ATM script and materials for your personal or internal business use.
3.2 Restrictions. You will not: (a) copy, resell, sublicense, or redistribute the script/materials; (b) reverse engineer, decompile, or attempt to derive source; (c) remove proprietary notices; (d) share access or credentials.
3.3 Updates. We may update or modify the script, presets, or materials at any time. Some updates may add, change, or remove features.
4.1 Respect. Keep discussions professional. No harassment, doxxing, spam, or illegal content.
4.2 No claims. Do not post false performance claims or "get-rich" marketing.
4.3 Moderation. We may warn, mute, or remove users who violate rules. Repeated or severe violations may result in termination.
5.1 Hypothetical results. Any backtests, simulations, or walk-forward results are hypothetical and have inherent limitations; they may not reflect actual trading or market conditions.
5.2 Past ≠ future. Past performance does not guarantee future results.
5.3 Methodology. Where we present results, we aim to disclose data windows, fees/slippage assumptions, sizing models, and other relevant methodology.
5.4 User differences. Your results will vary due to execution, latency, fees, slippage, settings, risk sizing, and market conditions.
6.1 Independent decisions. You make your own decisions and assume all risk.
6.2 Compliance. You will comply with all applicable laws and regulations (e.g., securities, commodities, derivatives, tax).
6.3 No pooling or advice. Do not pool funds, signal trades to others as advice, or operate copy-trading for a fee unless permitted by law.
7.1 TradingView & brokers. Our tools may depend on third-party platforms (e.g., TradingView, brokers, data providers). Those services are governed by their own terms and fees.
7.2 Integrations. Any integrations (e.g., webhooks) are provided as examples; you are responsible for configuration, testing, and monitoring.
8.1 Fees. Prices and billing terms are shown at checkout and may change upon renewal. Taxes may apply.
8.2 Renewals. Subscriptions renew automatically unless cancelled before the renewal date.
8.3 Refunds. Unless stated otherwise on the specific checkout page, fees are non‑refundable. Where a refund policy exists, it will be clearly stated and honored.
9.1 Ownership. We own all rights, title, and interest in the platform, script, presets, course content, and brand.
9.2 Feedback. If you provide suggestions, we may use them without obligation or compensation.
10.1 As‑is. The platform, script, and content are provided "as is" and "as available." We disclaim all warranties to the fullest extent permitted by law, including merchantability, fitness for a particular purpose, and non‑infringement.
10.2 Market risk. Trading involves risk, including potential loss of principal.
10.3 No guarantee. We do not guarantee results, uptime, uninterrupted access, or error‑free operation.
11.1 Cap. To the maximum extent permitted by law, our total liability for any claims arising out of or relating to the services is limited to the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.
11.2 No special damages. We will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for lost profits, revenue, data, or goodwill.
You agree to indemnify, defend, and hold harmless ATM and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from: (a) your use of the services; (b) your violation of these Terms or laws; (c) your content or settings; or (d) your trading or automation decisions.
13.1 By you. You may cancel your subscription at any time; access continues until the end of your billing period.
13.2 By us. We may suspend or terminate access if you breach these Terms, misuse the services, or for security/legal reasons.
13.3 Effect. Upon termination, your license ends and you must stop using and delete the script/materials. Sections intended to survive (e.g., IP, disclaimers, limitations, indemnity) survive termination.
Some features or presets may be labeled beta, experimental, or pre‑release. They may be incomplete, less stable, or change at any time.
15.1 Jurisdictional limits. We may restrict access in certain jurisdictions. You are responsible for understanding local rules that apply to you.
15.2 Export. You will comply with applicable export control and sanctions laws.
We may update these Terms from time to time. Material changes will be notified via the platform or email. Continued use after the effective date constitutes acceptance.
17.1 Governing law. These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws principles.
17.2 Venue. Courts located in Wilmington, Delaware shall have exclusive jurisdiction, unless otherwise required by law.
17.3 Informal resolution. Contact us first to try to resolve any dispute.
